1. Acceptance of Terms

By accessing or using Mermaid Phone, you agree to be bound by these Terms of Service. If you use Mermaid Phone for a business, you represent that you are authorized to connect that business, configure its phone agent, and provide instructions on its behalf. If you do not agree to these terms, do not use the Service.

2. Service Description

Mermaid Phone provides an AI-powered phone answering and scheduling service for small businesses. The Service may include AI call answering, appointment scheduling, call summaries, transcripts, customer records, booking links, connected calendar and payment tools, account chat with Sirena, and related dashboard features.

Sirena is the AI account assistant inside Mermaid Phone. Sirena may help you review your schedule, update supported settings, create support tickets, and explain account information. Sirena can only use the features and tools we make available to her. If a request is outside those abilities, she should create a support ticket or direct you to a human support path.

3. Account Responsibilities

You are responsible for maintaining the security of your account credentials and for all activity under your account. You must provide accurate business information, keep your services, prices, hours, policies, and booking rules current, and review changes made through the dashboard, onboarding, phone calls, chat, or connected tools.

If you ask Sirena or another Mermaid Phone feature to update your account, those changes may affect what callers hear, which appointments can be booked, and what information appears in your dashboard. You are responsible for checking that the changes are correct for your business.

4. Customer Data and Consent

You are responsible for the customer information you collect, upload, or allow Mermaid Phone to process for your business. This includes names, phone numbers, emails, appointment details, notes, call recordings, messages, and any information customers provide to your AI phone agent.

You are responsible for giving callers and customers any notices required by law, obtaining any required consents, honoring opt-outs, and using Mermaid Phone in a way that is appropriate for your industry and location. Mermaid Phone is not a substitute for your own legal, compliance, or professional obligations.

5. Call Recording and AI Use

Calls handled by Mermaid Phone may be answered by AI, recorded, transcribed, summarized, and stored so the Service can answer calls, book appointments, create records, and show call history. You agree not to disable or remove required call recording disclosures from your AI greeting.

AI can misunderstand information, make mistakes, or fail to complete an action. You should review call summaries, appointments, customer records, and account settings, especially when the information is important, sensitive, time-sensitive, or financially meaningful.

6. SMS and Messaging

If you use SMS or messaging features, you must only message people who have given appropriate permission, and you must honor stop, unsubscribe, and other opt-out requests. SMS features may require carrier approval, A2P or similar registration, business verification, setup time, additional terms, and ongoing compliance with carrier rules.

Mermaid Phone may limit, suspend, or refuse messaging features if we believe they could violate law, carrier rules, platform policies, or our own abuse controls.

7. Connected Calendars, Payments, and Other Tools

You may connect calendar, payment, booking, or other business tools to Mermaid Phone. When you do, you authorize Mermaid Phone to use those connections to provide the Service, such as reading availability, creating appointments, preparing payment links, showing account status, or updating supported settings.

Payment processing is provided by third-party payment providers such as Stripe or Square. Mermaid Phone does not store full card numbers. Refunds, disputes, chargebacks, tax treatment, tips, deposits, and customer payment policies remain your responsibility unless we separately agree otherwise.

8. Support Tickets and Human Review

When Sirena cannot complete a request, finds something that needs a person, or you ask for help, she may create a support ticket for the Mermaid Phone team. Support tickets may include your request, account context, and relevant summaries so a human can review the issue. We try to limit ticket contents to what is needed to help.

9. No Regulated or Medical Use Without Separate Agreement

Mermaid Phone is not designed for emergency services, medical diagnosis, clinical decision-making, protected health information, regulated financial advice, legal advice, or other regulated use unless we have a separate written agreement that specifically covers that use. Do not use the Service to collect or process protected health information or similarly regulated data unless we have agreed to support that use in writing.

10. Acceptable Use

You agree not to use Mermaid Phone to:

  • Violate any applicable laws or regulations
  • Engage in fraudulent or deceptive practices
  • Harass, threaten, or harm others
  • Transmit spam, unsolicited messages, or illegal content
  • Collect protected or regulated information without written approval
  • Use AI responses to impersonate a human or hide required disclosures
  • Interfere with the operation of our service

11. Billing and Payments

Paid plans are billed monthly. You authorize us to charge your payment method for the applicable subscription fees. You can cancel at any time; cancellation takes effect at the end of the current billing period.

Usage-based fees, phone number fees, SMS fees, setup fees, carrier approval costs, and connected service fees may be billed separately when applicable. If your account uses auto-refill or a balance feature, you authorize us to charge the selected payment method according to the settings you enable.

12. Data Retention and Deletion

We retain account, call, message, customer, appointment, support, billing, and integration data as described in our Privacy Policy and as needed to run the Service, comply with law, resolve disputes, prevent abuse, and maintain business records. Some data may remain in backups, logs, provider systems, or legally required records for a limited time after deletion.

13. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We are not liable for any damages resulting from service interruptions, provider outages, AI errors, missed calls, missed messages, delayed notifications, unavailable integrations, or appointment errors.

14. Limitation of Liability

Mermaid Phone is provided "as is" without warranties of any kind. Our liability is limited to the amount you paid for the service in the preceding 12 months.

15. Changes to Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the updated terms.
